Jon Lindsay
Meets With Houston Homeowners
July 19, 2002
Houston, TexasTexas Senator Jon Lindsay met with Houston Homeowners in hopes of bringing ideas forward that may help resolve the many controversial issues surrounding Homeowner Associations.Homeowner Associations and their Lawyers have been under fire for their questionable actions and heavy handed foreclosure actions.
Those attending the informal gathering with Texas State Senator Jon Lindsay pictured above are Houston's Johnny Johnson, Harvella Jones and Johnny Jones. Others invited and attending included Attorney Ken Okurie, Palma Sales and Steve Solcich.
Among topics discussed was needed and effective HOA and Attorney Oversight relative to the history of HOA Foreclosure filings by what is seen as out of control Homeowner Associations.
HV Homeowners are waking up to discover that according to the HV Board and their latest one-sided newsletter, a CRISIS and a CROSSROADS is at hand. Their newest "propaganda piece" with no opposing views allowed, further explains that HV homeowners have little choice but to open their wallets and give up more of their rights if life as we know it is to continue. As usual, the very same Fear Tactics used so successfully in the past is the weapon of choice selected for this latest power-grab scheme.

The bottom line is simple:
- The Board of Directors are REQUIRED by Texas Law and our Governing Documents to operate within the confines of our
Deed Restrictions and Bylaws (their job descriptions).
- The Board of Directors CANNOT amend and/or modify (contrary to what some would like you to believe) OUR Governing Documents at their whim. Those rights belong ONLY to you and REQUIRE a 75% Majority Paper Ballot Recorded Vote of The Property Owners to Modify our Deed Restrictions or Bylaws.
- Our
governing documents are precise and clearly outline the limits of the Board's Authority. These limits are a designed protection for your family and precisely why they were included in the original drafts of our bylaws and deed restrictions.
- Their is no workable mechanism short of expensive court litigation to force a Board of Directors to operate within our governing documents if they choose to ignore them. This creates a needless and expensive string of abuses when a board chooses to abuse their authority using our money defending indefensible actions. This abuse of our governing system must stop.
